1. Provider and service
Houby AI is provided by Daniel Hanuš, Business ID 04148193, Hliník 240/30, 750 02 Bochoř, Czech Republic. For support, complaints and questions, contact support@decadetools.com. The app offers a mushroom atlas, educational quizzes, local storage of your finds and indicative mushroom recognition from photos. These terms apply to the app and its related services. Personal data processing is described in the separate Privacy policy.
2. Apple and the standard licence agreement
For an app downloaded from the Apple App Store, the Apple Standard End User License Agreement (Standard EULA) applies alongside these terms unless a custom licence agreement is provided. Under the Standard EULA, the app provider grants your licence; the relationship concerning the app is between you and the provider, not Apple. Apple has no obligation to provide maintenance or support for the app. Daniel Hanuš provides Houby AI support using the contact details below. Apple and its subsidiaries are expressly designated as third-party beneficiaries of the Standard EULA and, upon your acceptance, have the right to enforce it against you. This does not affect consumer rights that cannot be excluded.
3. Mushroom recognition and safety
The app’s result is indicative educational information, not expert identification of a find, medical advice or confirmation of edibility. Photo recognition can identify a species incorrectly, including mistaking a poisonous mushroom for an edible one; a photo may not show all features needed for identification. A species name, candidate ranking or match score does not confirm that a particular mushroom is safe to eat. Never eat mushrooms or serve them to another person based on the app’s result. If in doubt, do not consume the mushroom and consult a qualified mycologist. If you suspect poisoning, call emergency medical services; Czech Toxicological Information Centre contacts are available on the TIS website. This notice does not limit your statutory rights or liability that cannot lawfully be excluded.
4. Your photos and other content
You retain the rights to photos and text you add to the app. Only upload content you are entitled to use, and avoid images of people, documents and confidential information. When you request online recognition, Cloudflare processes up to three selected photos and any text context, then passes them to Google Gemini API for analysis. For this feature, you authorise the necessary technical processing of the selected content. This authorisation is limited to providing the feature you request; it does not publish your photos or grant us a general licence to use them in advertising. The Privacy policy explains recipients, retention and your rights. This contractual provision does not replace separate consent where it is required for a particular processing of personal data.
5. Purchases and subscriptions
A paid subscription is available only when an offer is displayed in the iOS app. Purchases are made through the Apple App Store. Before you confirm a purchase, the App Store displays the current price, currency, billing period and any trial period, including when billing starts. If an offer includes an automatically renewing trial, the displayed price is charged after the trial unless you turn off automatic renewal in time. The subscription subsequently renews under the offer unless you cancel renewal. The app does not currently support Android subscriptions. The details displayed by the App Store for the particular purchase are decisive.
6. Management, cancellation and refunds
You can manage your subscription and turn off automatic renewal in your Apple Account subscription settings, or through the app’s subscription-management option where available. If you do not want a free trial to become a paid subscription, cancel at least 24 hours before it ends, following Apple’s instructions. Cancelling automatic renewal usually does not end an already paid period; follow the status displayed by the App Store. Deleting the app does not cancel a subscription. You can request a refund through Apple Report a Problem. Apple assesses the request, without affecting any statutory rights you may have against the service provider.
7. Consumer rights and complaints
If you use the service as a consumer, you retain mandatory rights under applicable law, including remedies for defective digital content or digital services and withdrawal rights where provided by law. Any statutory exception to a right of withdrawal depends on the type of contract and fulfilment of the relevant conditions; these terms do not themselves constitute your consent to immediate performance or a waiver of withdrawal rights. We accept complaints and acknowledge receipt; describe the problem and include only information needed to handle it. We handle digital-service complaints within a reasonable time considering the service’s nature and purpose. Defects are remedied free of charge and without significant inconvenience. Subject to applicable law, you may request a proportionate price reduction or terminate the contract if bringing the service into conformity is impossible or disproportionate, a defect is not remedied within a reasonable time, a defect recurs, or its seriousness justifies an immediate remedy. After the reasonable complaint-handling period expires without resolution, you may seek a price reduction or terminate as provided by law. For digital content and digital services, this is not a universal fixed 30-day period; it depends on the service’s nature and the purpose for which you requested it. If a dispute cannot be resolved directly, you may contact the competent consumer alternative dispute resolution body; in the Czech Republic, this may be the Czech Trade Inspection Authority. See its ADR information (Czech). This does not limit your right to go to court.
8. Use and availability
The atlas and quizzes can be used on your device. Online recognition requires an internet connection and available third-party services. Do not use the app to bypass security restrictions, disrupt the service or overload it with automated requests. The service may be temporarily unavailable, for example during maintenance, a provider outage or a security incident. This does not affect statutory obligations to provide a paid digital service.
9. App content and third-party rights
You may use the app and its original content for personal educational purposes within the app’s functionality and applicable law. Text, graphics and other original materials may be protected by intellectual property rights. The atlas may contain third-party photos; their sources and licences are listed in the app or on the Photo licences page. Rights expressly granted under open licences remain unaffected.
10. Liability and governing law
The app and its recognition results are not error-free or an expert opinion. To the extent permitted by law, the provider is liable for damage under applicable legal rules. Nothing in these terms excludes or limits liability for personal injury, intentional misconduct, gross negligence or other liability that cannot lawfully be limited, nor does it limit statutory consumer rights. These terms are governed by Czech law, without depriving consumers of mandatory protections applicable under the law of their habitual residence.
11. Changes and contact
We may update these terms when the service or legal requirements change, publishing the new version with its effective date. Where a change requires specific notice or gives you the right to reject it or terminate the contract, we will follow applicable law.
